Welcome to The epic cake. These Terms of Service ("Terms") constitute a binding legal agreement between you ("User", "Client", or "You") and The epic cake, an entity operating under the laws of the Commonwealth of Puerto Rico ("We", "The Company").

By accessing, installing, purchasing, or using any of our websites, Discord bots (e.g., Cosmos+, Cosmos+ Networks, Cosmos+ Shield, ARAID, Helper+, and any past, present or future bots), control panels (dashboards), APIs, physical goods, digital assets, or related services (collectively, the "Ecosystem" or "Services"), you agree to be bound by these Terms.

1. License to Use and Intellectual Property

1.1 License Grant: Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for your personal use or internal community use.

1.2 Ownership: All rights, title, and interest in the Services, including but not limited to: source code, algorithms, visual interfaces, trademarks ("The epic cake", "TECIA"), and content created by us, are the exclusive property of The epic cake.

1.3 Restrictions and Plagiarism: You may not: (a) reverse engineer, decompile, or attempt to extract the source code of our Services; (b) resell, sublicense, or distribute our Services without written authorization; (c) use the Services to train Artificial Intelligence models without consent. It is strictly prohibited to engage in any form of plagiarism of our systems, brands, branding materials, Discord servers, or any related content. Such actions are punishable and will result in sanctions.

2. Data Collection and Usage Metrics

To continuously improve our products and offer a personalized experience, you authorize The epic cake to monitor and analyze your use of the Services.

2.1 Telemetry and Analytics: We reserve the right to collect technical, behavioral, and performance data in real-time. This includes, but is not limited to: response times, command usage frequency, interface interactions, system errors, and navigation patterns.

2.2 Data Usage: The collected information will be used for infrastructure optimization, research and development (R&D) of new features, security, and commercial statistical purposes. We need to collect significantly more metrics regarding users and their use of our systems. Furthermore, whenever you use a Premium Limited license, a free service, or an item won in a giveaway, you agree that we will collect additional usage metrics to improve our systems.

2.3 Evolution of Services & Future Telemetry: Our systems are continuously evolving. We reserve the absolute right to introduce new telemetry tracking, data collection mechanisms, and premium functionalities at any time without prior notice. Continued use of the Services after such updates constitutes your explicit consent to the modified data collection practices and terms.

3. Payments, Refunds, and Subscriptions

3.1 Processing: Payments are processed by third parties (WHOP, Stripe, PayPal). We do not store your full financial information.

3.2 Premium Subscriptions & No Refund Policy: Due to the digital and intangible nature of our products, all sales are final. Specifically regarding Premium Keys, there are absolutely no refunds under any circumstances once the key has been delivered or activated. We do not offer refunds for "change of mind", server closure, or subjective dissatisfaction.

3.3 Lifetime Tier Definition: Any product, subscription, or tier labeled as "Lifetime" means the lifetime of the service. If Cosmos+ or the specific service shuts down, is discontinued, or significantly altered in the future, you are not entitled to a refund. "Lifetime" does not mean your physical lifetime.

3.4 Chargebacks: Any attempt to initiate a fraudulent chargeback will result in the immediate termination of your account, revocation of any Premium licenses, and a permanent ban from all our Services (global blacklist).

4. User Conduct and Acceptable Use

You agree not to use the Services to:

4.1 Administrator Responsibilities: Server Administrators who are granted access to detailed user metrics (such as via the Premium Dashboard or User Lookup Tools) explicitly agree not to use this data to harass, stalk, witch-hunt, or discriminate against users. Misuse of the provided analytics will result in immediate license revocation and bot removal.

4.2 Support and Moderation Access: TECIA members reserve the right to enter your Discord server if you use our bots, for the explicit purposes of investigating issues, preventing abuse, and providing technical support.

4.3 User-Generated Content Liability (Safe Harbor): The Company acts strictly as a passive conduit for any content generated, uploaded, or transmitted by users (including text, images, server setups, or confessions) through our Services. We are not the publishers of User-Generated Content (UGC) and explicitly disclaim all liability for any illegal, infringing, defamatory, or harmful content posted by users (including Copyright infringement or CSAM). While we comply with valid DMCA takedown notices and law enforcement requests regarding illegal content, we assume no active obligation to monitor or pre-screen all UGC.

5. Age Restrictions

Users must meet Discord's minimum age requirements (13 years or older, depending on your jurisdiction) to use our bots. Given that our services include a simulated casino and virtual economy, users under the minimum age are strictly prohibited from utilizing these features.

6. Virtual Economy & Casino Disclaimer

Our bots include complex economy systems and simulated casino games. We explicitly state that virtual currency (e.g., "Planets", coins) and Casino games have no real-world monetary value, cannot be exchanged, cashed out, or redeemed for real money, goods, or services, and are provided strictly for entertainment purposes. We are not liable for any virtual losses incurred within these simulated games.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE EPIC CAKE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

7.1 Data Accuracy: We do not guarantee the accuracy, completeness, or reliability of any analytics, metrics, or lookup data provided through our dashboards or bots. Decisions made based on our data are at your own risk.

7.2 Third-Party Integrations & APIs: We are not responsible for any issues, data breaches, or downtime arising from the interaction of our Services with third-party platforms (such as Discord API outages, Stripe, or Roblox).

8. Limitation of Liability & Indemnification

IN NO EVENT SHALL THE EPIC CAKE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, PROFITS, OR REPUTATION), ARISING OUT OF THE USE OF THE SERVICES. WE ARE NOT RESPONSIBLE FOR ANY DAMAGES, DATA LOSS, OR SERVER RAIDS THAT OCCUR DUE TO BOT DOWNTIME, MISCONFIGURATION BY THE SERVER ADMINISTRATOR, OR UNFORESEEN SOFTWARE BUGS. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS.

8.1 Indemnification (Hold Harmless): You agree to indemnify, defend, and hold harmless The epic cake, its affiliates, its developers, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Services or misconfiguration caused damage to a third party or a Discord server.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Puerto Rico. Any legal dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the state or federal courts located in San Juan, Puerto Rico.

9.1 Force Majeure: The Company shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, severe internet outages, or third-party API failures (e.g., Discord platform going offline).

9.2 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the rest of these Terms will otherwise remain in full force and effect.

10. Giveaways and Promotions

Any giveaway can be rerolled or cancelled at our sole discretion. Any prize labeled as "Permanent" or "Lifetime" may be revoked at any time due to the product no longer being available, version changes, or for any other operational reason.

11. Non-Affiliation Disclaimer

The epic cake and its Ecosystem (including Cosmos+) are independent entities. We are NOT affiliated, associated, authorized, endorsed by, or in any way officially connected with Discord Inc., Roblox Corporation, WHOP, or any of their subsidiaries or affiliates. The names "Discord" and "Roblox" as well as related names, marks, emblems, and images are registered trademarks of their respective owners.
