End-User License Agreement (EULA)

Software, Source Code & Digital Assets Licensing

This End-User License Agreement ("EULA") is a binding legal agreement between you ("Licensee") and The epic cake ("Licensor"). This EULA governs your use of any downloadable software, source code, scripts, configurations, or digital assets ("Software") provided by us under a Self-Hosted (Model B) delivery or direct purchase.

BY DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU EXPRESSLY AGREE TO BE BOUND BY THE TERMS OF THIS EULA.

Subject to your strict compliance with this EULA and payment of applicable fees via WHOP, Stripe, or PayPal, we grant you a limited, non-exclusive, non-transferable, and non-sublicensable license to use the Software strictly for your personal use or internal community use.

This license is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms (e.g., leaking the code or initiating a fraudulent chargeback). Upon termination, you must cease all use of the Software and destroy all copies, full or partial, in your possession. We reserve the right to remotely revoke access keys if a violation is detected.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ASSUME ALL RESPONSIBILITY FOR SELECTING THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AS WELL AS FOR THE INSTALLATION AND CONFIGURATION IN YOUR OWN ENVIRONMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE EPIC CAKE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, SERVER OUTAGES, OR HARDWARE FAILURE) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
