Terms of Service

These Terms of Service govern your access to and use of all websites, Discord bots, dashboards, premium features, and digital products (collectively, the “Services”) provided by The epic cake, a startup operating in the Commonwealth of Puerto Rico.

1. Acceptance

By using our Services or making any purchase, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

2. Services & Payments

Certain features are paid (Premium bots, dashboard subscriptions, one-time purchases, etc.). All payments are final and non-refundable except where required by law. We use third-party payment processors (Stripe, PayPal, etc.) – your payment data is handled directly by them, not by us.

3. License

Paid plans grant you a limited, non-transferable license to use the premium features during the subscription period. Access ends automatically upon cancellation or non-payment.

4. Acceptable Use

You may not use the Services for illegal activities, spam, raids, harassment, malware distribution, reverse engineering, resale, or any purpose that violates Discord’s Terms of Service.

5. Third-Party Services

We use Cloudflare, Google Analytics, Discord API, Stripe, PayPal, and other third-party providers. Their respective terms and privacy policies also apply.

6. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee 100% uptime, error-free operation, or that features will never change.

7. Limitation of Liability

To the maximum extent permitted by law, The epic cake shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data.
Our total liability in any matter arising from these Terms or the Services is limited to the amount you paid us in the last 12 months (or US $50 if you paid nothing).

8. Refunds

Due to the digital nature of our products, all sales are final. We may offer refunds at our sole discretion on a case-by-case basis.

9. Termination

We may suspend or terminate your access immediately, with or without notice, for violation of these Terms or non-payment.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico. Any dispute shall be resolved in the courts of San Juan, Puerto Rico.

Privacy Policy

We respect your privacy and comply with applicable data protection laws including Puerto Rico’s Act 81-2019 and international standards.

Data We Collect

• Discord User ID, Server ID, and settings you configure
• Email address (only if you create an account or make a purchase)
• Payment information (processed securely by Stripe/PayPal – we never see full card details)
• IP address and usage logs (for security and analytics)
• Google Analytics (optional – anonymized IP) and Cloudflare data

How We Use Your Data

• Provide and improve the Services
• Process payments and prevent fraud
• Send important updates (new features, outages)
• Comply with legal requirements

Data Sharing

We do not sell your personal data. We only share it with trusted providers (Stripe, Cloudflare, Google, hosting companies) under strict contracts.

Your Rights

You can request access, correction, or deletion of your data at any time via the contact form on our website. We will respond within 30 days.
